Organic Farming Agreement

However, organic farmers should not be completely discouraged by the current difficult land rental climate, as their way of producing can be attractive to a single type of landowner. The OFRF will summarize research on the main challenges facing farmers and assess the effectiveness of participation to producers and dissemination of information to stakeholders. An evaluation of the research will be carried out on climate change mitigation, resilience and adaptation. The agency will identify gaps and make recommendations for ecological research priorities that reflect the greatest benefits to producers, communities and the environment. National organic standards address the methods, practices and substances used in the production and handling of processed crops, animals and agricultural products. The standards stipulate that in general, all natural (non-synthetic) substances are allowed in organic production and all synthetic substances are prohibited. The National List of Permitted Synthetic and Non-Synthetic Substances contains specific exceptions to the rule. This summary comes from the USDA`s National Organic Program (NOP). As part of the 3-year agreement, the OFRF will compare the priorities identified in 2016 and 2021 of the National Biological Research Program (NORA), a report that the OFRF produces and publishes every five years. NORA contains comprehensive recommendations for future investments in organic farming based on surveys and listening sessions with organic farmers, and is used to obtain recommendations that the OFRF submits to the USDA to prioritize its programs. Sometimes factors that are not strictly based on costs also need to be taken into account in the agreement. For example, if a landowner wants to switch to organic production and the tenant is not sure or hesitant, it may be a good idea to adjust the crop sharing agreement in favor of the tenant during the transition period. This adjustment would offset the risk of a decline in yield during the transition if the crop is not eligible for organic premiums (a process that usually takes three years).

Conversely, if a tenant wants to transition to organic production, but the landowner is not sure, it may be a good idea to temporarily switch to a multi-year cash lease. The tenant then assumes the return risk during the transition in exchange for the security of a longer-term lease. How should a crop-sharing agreement be structured to provide a fair return to the landowner and tenant in such a situation? The agreement can be adapted in several ways, depending on the preferences and circumstances of the parties concerned. This integrated project proposal will provide current and evolving organic farmers with a critical, concise and accessible guide to interpreting and managing legal contracts with processors, traders and retailers who increasingly dominate farmers` ability to successfully market organic agricultural products.

The organic sector uses contracts at a much higher rate than the conventional sector. However, there is little independent and reliable legal information available to the country`s 20,000 organic farmers when a production or marketing contract is presented to them or they wish to offer.

The objective of this project is to develop and demonstrate educational tools for best practices that improve the ability of agricultural producers to make informed decisions and manage their risks when accepting contracts for the sale of their organic agricultural products; and to promote a marketing system in which producers and processors, merchants and retailers can thrive.
